• meets local safety, emissions, or technical standards.

All risks associated with import approval, testing, modification, certification, registration, and local compliance are borne exclusively by the Customer.

4. Vehicle Condition & Used Vehicle Risk

4.1 Used Vehicles

Used vehicles are sold “AS IS, WHERE IS”.

Used vehicles may have:

• wear and tear consistent with age and mileage;
• cosmetic defects;
• prior repairs or repainting;
• mechanical, electrical, or electronic aging;
• unknown or hidden defects.

No used vehicle should be considered free of defects, even if inspected.

4.2 No Guarantee of Mileage or History

Odometer readings, service history, and prior usage are based on available information and are not guaranteed unless expressly stated in writing.

5. Inspection Limitations

Any inspection or condition report provided:

• is limited in scope;
• is non-invasive and non-destructive;
• does not include dismantling or full mechanical testing;
• does not eliminate the possibility of hidden or future defects.

Inspections reduce risk but do not eliminate it.

6. Electric Vehicle (EV) Specific Risks

Electric vehicles involve additional and specific risks, including but not limited to:

• Battery degradation over time, storage, and usage
• Reduced driving range compared to advertised figures
• Charging speed variability
• Software, connectivity, navigation, and app features that may be region-locked or disabled outside China
• OEM restrictions on accounts, updates, or diagnostics
• Differences in charging standards requiring adapters or conversion

Battery condition, capacity, and performance are not guaranteed.

EV batteries also carry inherent fire and thermal risks. Certain ports, carriers, or authorities may impose special handling, quarantine, or refuse shipment.

7. Shipping, Logistics & Delay Risk

International shipping is subject to factors beyond the Company’s control, including:

• Port congestion
• Vessel delays or rollovers
• Route changes or transshipment
• Weather conditions
• Customs inspections
• Labor strikes
• Regulatory changes

All shipping timelines are estimates only. Delays do not constitute breach of contract or grounds for cancellation.

8. Damage, Loss & Insurance Risk

Vehicles may be exposed to handling, movement, and environmental conditions during transport.

Unless expressly agreed in writing:

• cargo insurance is not included;
• the risk of loss or damage transfers according to the agreed Incoterms®.

Failure to arrange adequate insurance may result in unrecoverable losses.

9. Customs, Seizure & Authority Actions

Customs and government authorities may, at their discretion:

• inspect vehicles;
• delay clearance;
• impose additional taxes, duties, or requirements;
• seize or refuse entry of vehicles.

Dragon Wagon Export Co., Ltd. is not responsible for actions taken by authorities in China or the destination country.

10. No Warranty & No After-Sales Support

Dragon Wagon Export Co., Ltd. does not provide:

• mechanical warranties;
• battery warranties;
• manufacturer warranty assurances;
• after-sales service or repair support in the destination country.

Any manufacturer warranty is subject to manufacturer rules and may be void or unenforceable outside China.

11. Financial, Currency & Market Risk

Vehicle prices, shipping costs, duties, taxes, and exchange rates may fluctuate.

The Company is not responsible for:

• currency losses;
• changes in market value;
• resale price expectations;
• financial losses resulting from regulatory or market changes.

12. No Reliance Statement

By engaging Dragon Wagon Export Co., Ltd., you acknowledge that:

• you have conducted your own due diligence;
• you have not relied on informal statements, assumptions, or expectations;
• only written contractual documents are binding.
